1. Acceptance of Terms

Welcome to Imdsolution (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Imdsolution website located at imdsolution.com (the “Site”) and any related services, features, content, or applications offered by Imdsolution (collectively, the “Services”).

By accessing, browsing, or otherwise using the Site or Services, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Site or Services.

2. Description of Service

Imdsolution is a news aggregation service. We automatically and/or manually collect headlines, article excerpts, images, and links from a wide variety of third-party news sources and other publicly available websites (“Third-Party Sources”). We present this aggregated content to our Users for informational and educational purposes. Imdsolution is not the original publisher or creator of the news content aggregated on the Site.

3. Intellectual Property Rights

3.1. Imdsolution’s IP

The Site, its original content, features, functionality, and the selection and arrangement thereof are and will remain the exclusive property of Imdsolution and its licensors. The Site and its content are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Imdsolution.

3.2. Third-Party Intellectual Property

All news articles, headlines, excerpts, images, videos, and other content sourced from Third-Party Sources (collectively, “Aggregated Content”) are the intellectual property of their respective owners and are used by Imdsolution under the doctrine of “Fair Use” as defined under Section 107 of the U.S. Copyright Act.

Imdsolution does not claim any ownership over the Aggregated Content. Our use of such content is transformative, providing a centralized, curated aggregation service for our Users. We believe our use of excerpts and links constitutes fair use because it is for non-commercial, educational, and informational purposes, does not substitute for the original work, and provides significant benefit to the original sources by driving traffic and attribution.

4. User-Generated Content

4.1. User Responsibility

The Services may allow users to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“User Content”). You are solely responsible for the User Content you post on or through the Services, including its legality, reliability, and appropriateness.

4.2. License Grant

By posting User Content on or through the Services, you represent and warrant that you own the User Content or have the right to use it and grant us the license to do so. You hereby grant Imdsolution a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Site and our business.

4.3. Prohibited Content

You agree not to post User Content that is: (a) illegal, obscene, threatening, defamatory, invasive of privacy, or infringing on intellectual property rights; (b) contains software viruses or any other computer code designed to interrupt or damage the Services; or (c) consists of unsolicited commercial messages (“spam”). We reserve the right to remove any User Content at any time, for any reason, without notice.

4.4. Disclaimer on User Content

Imdsolution does not endorse and is not responsible for any User Content. All User Content expresses the views of the author solely, and we expressly disclaim any and all liability in connection with User Content. You understand that by using the Services, you may be exposed to User Content that is offensive, indecent, or objectionable.

5. Third-Party Links and Content

The Site contains links to external Third-Party Sources and websites that are not owned or controlled by Imdsolution. We provide these links solely as a convenience to our Users.

IMDSOLUTION HAS NO CONTROL OVER, AND ASSUMES NO RESPONSIBILITY FOR, THE CONTENT, ACCURACY, PRIVACY POLICIES, OR PRACTICES OF, OR OPINIONS EXPRESSED IN ANY THIRD-PARTY SOURCES OR WEBSITES. You acknowledge and agree that Imdsolution shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites that you visit.

6. Digital Millennium Copyright Act (DMCA) – Safe Harbor

Imdsolution respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website, Imdsolution will respond expeditiously to claims of copyright infringement committed using the Site that are reported to our designated Copyright Agent.

If you are a copyright owner, or authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our designated Copyright Agent at [email protected]. Upon receipt of the Notice as described below, Imdsolution will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.

DMCA Notice of Alleged Infringement (“Notice”):

Identify the copyrighted work that you claim has been infringed.
Identify the material you claim is infringing and that you want removed, with enough detail for us to locate it.
Provide your mailing address, telephone number, and, if available, email address.
Include both of the following statements in the body of the Notice:
- “I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”

IMDSOLUTION MAKES NO WARRANTY THAT (I) THE SITE OR SERVICES WILL MEET YOUR REQUIREMENTS; (II) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.

7.2. Content Accuracy Disclaimer

IMDSOLUTION IS AN AGGREGATOR AND DOES NOT VERIFY THE ACCURACY, COMPLETENESS, OR USEFULNESS OF THE AGGREGATED CONTENT. WE ARE NOT RESPONSIBLE FOR ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR THE RESULTS OBTAINED FROM THE USE OF SUCH CONTENT. ALL AGGREGATED CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, FINANCIAL, MEDICAL, OR OTHER PROFESSIONAL ADVICE. ANY RELIANCE YOU PLACE ON SUCH INFORMATION IS STRICTLY AT YOUR OWN RISK.

7.3. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IMDSOLUTION, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to defend, indemnify, and hold harmless Imdsolution and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Site or Services, by you or any person using your account; b) a breach of these Terms, or c) User Content posted on the Services.

9. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.

10. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will cease immediately.

11. Governing Law & Dispute Resolution
